These Terms of Service (“Terms”) are a legal agreement between you and Gave It A Spin (“we,” “us,” or “our”). They govern your use of our website at gaveitaspin.com and our application at app.gaveitaspin.com (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Please also review our Privacy Policy, which describes how we collect, use, and share your information.
1. Agreement to Terms
By creating an account, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. During registration, you will be asked to explicitly accept these Terms. Your continued use of the Service after any changes to these Terms constitutes acceptance of those changes (see Section 16).
2. Who We Are
Gave It A Spin is a social listening tracker for physical media collectors — vinyl records, CDs, cassettes, and more. We help you log what you’re spinning, track your collection, and connect with other collectors.

3. Eligibility
To use the Service, you must:
- Be at least 13 years of age. During registration, you will be asked to confirm your age. If we learn that a user is under 13, we will terminate their account and delete their data within 30 days (see our Privacy Policy, Section 11).
- Have the legal capacity to enter into a binding agreement.
- Not have been previously suspended or removed from the Service for a violation of these Terms.
The Service is currently intended for users in the United States. We plan to expand to other regions in the future and will update these Terms accordingly. If you access the Service from outside the United States, you do so at your own discretion and are responsible for compliance with local laws.
4. Your Account
4.1 Registration
To access most features of the Service, you must create an account by providing a valid email address, a username, and a password. You must also confirm that you are at least 13 years old and accept these Terms and our Privacy Policy.
By creating an account, you also agree to receive occasional marketing emails from us, such as product updates and new features. You can unsubscribe at any time using the link included in any marketing email. Unsubscribing does not affect transactional emails required for your account (such as email confirmation and password reset).
4.2 Accuracy
You agree to provide accurate, current, and complete information during registration and to keep it updated. We may suspend or terminate your account if any information is inaccurate, misleading, or incomplete.
4.3 Security
You are responsible for safeguarding your password and any other credentials used to access your account. Do not share your login credentials with anyone. You are responsible for all activity that occurs under your account, whether or not you authorized it. If you suspect unauthorized access, contact us immediately at hello@gaveitaspin.com.
4.4 One Account Per Person
Each person may maintain only one account. Creating multiple accounts to circumvent restrictions, manipulate features, or mislead other users is prohibited and may result in termination of all associated accounts.
5. The Service
5.1 What We Provide
Gave It A Spin lets you:
- Log listening sessions (“spins”) with optional ratings (1–10) and free-text notes
- Import your physical media collection from Discogs via OAuth
- Scrobble plays to Last.fm automatically when enabled
- Follow other collectors and see their listening activity in a real-time feed
- View listening stats — most-spun releases, highest-rated, 30-day patterns
- Generate QR codes for releases in your collection
- Control your profile visibility — public or private (default: private)
5.2 No Guarantees of Availability
We strive to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to provide advance notice of planned downtime.
5.3 Changes to the Service
We may modify, update, or discontinue features of the Service at any time. If we make changes that materially reduce the core functionality of the Service, we will make reasonable efforts to notify you in advance. We are not obligated to maintain, support, or offer any particular feature.
6. Beta Service Disclaimer
The Service is currently in beta and is provided free of charge. During this period:
- Features may change, be added, or be removed without advance notice.
- You may encounter bugs, incomplete features, or unexpected behavior.
- We may reset, migrate, or restructure data if necessary for development purposes. We will provide advance notice if this would affect your stored data.
6.1 Future Paid Features
We may introduce paid features or subscription tiers in the future. If and when we do:
- We will provide reasonable advance notice before any feature that is currently free becomes part of a paid tier.
- We will not retroactively charge you for usage during the free beta period.
- Pricing and terms for paid features will be communicated clearly before you are asked to pay.
7. Your Content
7.1 What Is “Your Content”
“Your Content” means any information, text, or data that you submit, post, or display through the Service, including:
- Spin logs (dates, ratings, notes)
- Profile information (username, display settings)
- Any other user-generated data
Your Content does not include data imported from third-party services (such as Discogs collection metadata or cover art), which remains subject to the terms of those services.
7.2 Ownership
You retain ownership of Your Content. We do not claim any ownership rights over what you create on the Service.
7.3 License You Grant Us
By submitting Your Content to the Service, you grant us a non-exclusive, worldwide, royalty-free license (sublicensable solely to service providers who help us operate the Service) to use, store, display, reproduce, and distribute Your Content solely for the purposes of operating, providing, and improving the Service. This license includes the right to display Your Content to other users in accordance with your privacy settings (public or private profile).
This license continues for as long as Your Content remains on the Service. When you delete Your Content or your account, this license ends, subject to reasonable technical delays and our data retention practices described in our Privacy Policy.
7.4 Public vs. Private Content
Your profile is private by default. When your profile is private, your spins and activity are visible only to users you have approved as followers. If you make your profile public, your spins, ratings, and notes are visible to all users of the Service.
You can change your profile visibility at any time in your settings.
7.5 Content Standards
Your Content must not:
- Contain unlawful, defamatory, harassing, or threatening material
- Infringe on the intellectual property or privacy rights of others
- Contain malicious code, spam, or phishing content
- Impersonate another person or misrepresent your affiliation with any person or entity
We reserve the right to remove any Content that violates these standards or these Terms.
8. Third-Party Integrations
8.1 Discogs
If you choose to connect your Discogs account, we use the Discogs API to import your music collection data (release titles, artists, labels, formats, cover art, and track listings). This connection requires you to authorize access via OAuth.
8.2 Last.fm
If you choose to enable Last.fm scrobbling, we transmit track metadata (artist, album, track title, and timestamp) to Last.fm on your behalf when you log a spin. Your ratings and notes are never shared with Last.fm.
8.3 Your Responsibilities
By using these integrations, you agree to comply with the terms of service of each third-party provider:

8.4 Our Relationship with Third Parties
We are not affiliated with, endorsed by, or responsible for Discogs, Last.fm, or any other third-party service. We do not control their availability, accuracy, privacy practices, or terms. If a third-party service changes its API, terms, or availability, it may affect the functionality of our Service. We are not liable for any such changes or disruptions.
You can disconnect any third-party integration at any time from your account settings. For details on how data flows between the Service and third parties, see our Privacy Policy.
9. Acceptable Use
You agree to use the Service only for its intended purpose — tracking and sharing your physical media listening activity. You agree not to:
- Scrape or harvest data — use bots, crawlers, or automated tools to extract data from the Service
- Abuse rate limits or APIs — send excessive automated requests or attempt to overload the Service
- Harass other users — engage in bullying, targeted harassment, hate speech, or intimidation
- Impersonate others — pretend to be another person, user, or entity
- Share credentials — share, sell, or transfer your account or login information
- Circumvent security — attempt to bypass authentication, access another user’s account, or exploit vulnerabilities
- Interfere with the Service — introduce malware, spam, or any code designed to disrupt the Service
- Violate laws — use the Service for any purpose that violates applicable federal, state, or local law
We reserve the right to investigate and take appropriate action against any user who violates this section, including suspending or terminating their account.
10. Intellectual Property
10.1 Our Intellectual Property
The Service — including its design, code, visual elements, logos, branding, and documentation — is owned by Gave It A Spin and is protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or create derivative works based on any part of the Service without our prior written consent.
“Gave It A Spin” and our logo are our trademarks. You may not use them without our permission.
10.2 Third-Party Content
The Service displays content from third parties, including:
- Discogs metadata — release titles, artist names, labels, track listings, and other catalog data retrieved via the Discogs API
- Cover art — album artwork sourced from Discogs
This content is the property of its respective owners and is displayed under the terms of the Discogs API. We do not claim ownership of third-party content. Your use of this content is subject to the applicable third-party terms.
10.3 Copyright Complaints
We respect intellectual property rights. If you believe that content on the Service infringes your copyright, please contact us at hello@gaveitaspin.com with the subject line “Copyright Complaint” and include:
- A description of the copyrighted work you believe has been infringed
- The location of the allegedly infringing content on the Service
- Your contact information
- A statement that you have a good-faith belief that the use is not authorized
- A statement, under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner
We will review and respond to valid complaints promptly.
10.4 Feedback
If you provide us with suggestions, ideas, or feedback about the Service, you grant us the right to use that feedback without restriction or compensation to you. You are not obligated to provide feedback.
11. Termination
11.1 Termination by You
You may stop using the Service at any time. To delete your account and associated data, email us at privacy@gaveitaspin.com with the subject line “Data Deletion Request.” We will complete the deletion within 30 days and confirm by email. See our Privacy Policy for details on what happens to your data upon deletion.
11.2 Termination by Us
We may suspend or terminate your account if we reasonably believe that:
- You have violated these Terms — we will generally provide notice and an opportunity to address the issue before termination, unless the violation is severe or poses an immediate risk
- Your use of the Service poses an immediate risk to other users, the Service, or third parties — in these cases, we may act without prior notice
- We are required to do so by law
- We decide to discontinue the Service — we will provide at least 30 days’ advance notice
11.3 Effect of Termination
Upon termination:
- Your right to use the Service ends immediately
- We will delete your personal data in accordance with our Privacy Policy (within 30 days, except where retention is required by law)
- Follow relationships involving your account are dissolved
- Your username is released
- Any provisions of these Terms that by their nature should survive termination will survive, including Sections 7.3 (License), 10 (Intellectual Property), 12 (Disclaimers), 13 (Limitation of Liability), 14 (Indemnification), and 15 (Dispute Resolution)
12. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, we disclaim all warranties, including but not limited to:
- Implied warranties of merchantability, fitness for a particular purpose, and non-infringement
- Accuracy or reliability of any content, data, or information available through the Service, including third-party content from Discogs or Last.fm
- Uninterrupted or error-free operation of the Service
- Security of your data (though we take reasonable measures to protect it — see our Privacy Policy)
The Service is in beta. You acknowledge that beta software may contain bugs, errors, and incomplete features, and you use the Service at your own risk.
13. Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of profits, loss of goodwill, or other intangible losses, arising out of or related to your use of (or inability to use) the Service.
- Our total liability to you for all claims arising out of or related to these Terms or the Service is limited to the greater of (a) the amount you have paid us in the six (6) months preceding the event giving rise to the claim, or (b) $10 USD.
- We are not liable for the actions, content, or practices of any third-party services (including Discogs and Last.fm), even if we link to or integrate with them.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities. In those jurisdictions, our liability is limited to the fullest extent permitted by law.
14. Indemnification
To the extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Gave It A Spin, its operator, and any affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney’s fees) arising out of or related to:
- Your violation of these Terms
- Your Content that infringes the rights of a third party
- Your violation of any applicable law in connection with the Service
15. Dispute Resolution
15.1 Governing Law
These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
15.2 Informal Resolution First
Before filing any formal legal proceeding, you and we agree to try to resolve the dispute informally for at least 30 days. To initiate informal dispute resolution, send a written description of your claim to hello@gaveitaspin.com with the subject line “Dispute Resolution.” We will work in good faith to resolve the matter.
15.3 Jurisdiction
If informal resolution does not resolve the dispute, any legal proceeding will be brought exclusively in the state or federal courts located in Delaware, United States. You and we consent to the personal jurisdiction of those courts.
16. Changes to Terms
We may update these Terms from time to time. When we do:
- We will update the “Last Updated” date at the top of this page.
- For material changes that affect your rights or obligations, we will notify you by email and/or by a prominent notice within the Service at least 15 days before the changes take effect.
- For non-material changes (such as clarifications, formatting, or corrections), we will update the date and the Terms without advance notice.
Your continued use of the Service after the effective date of any changes constitutes acceptance of the updated Terms. If you do not agree with the changes, you should stop using the Service and may request deletion of your account.
17. General Provisions
17.1 Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
17.2 Waiver
Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision. A waiver of any provision is effective only if in writing and signed by us.
17.3 Assignment
You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms in connection with a merger, acquisition, sale of assets, or similar transaction. If such a transfer occurs, we will notify you by email and/or a prominent notice on the Service, consistent with the notice provisions in our Privacy Policy.
17.4 Force Majeure
We are not liable for any delay or failure to perform our obligations under these Terms due to circumstances beyond our reasonable control, including natural disasters, acts of government, internet or infrastructure failures, power outages, or third-party service disruptions (such as Discogs or Last.fm outages).
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Gave It A Spin regarding your use of the Service. They supersede any prior agreements, communications, or understandings, whether written or oral, relating to the subject matter of these Terms.
